Acceptance of Terms
By creating an account, accessing, or using any part of the Rentalize platform, you agree to be bound by these Terms, the Rentalize Privacy Policy, and any other legal notices or conditions on the platform. We reserve the right to update these Terms from time to time. It is your responsibility to check these Terms regularly for any changes. Continued use of the platform following updates constitutes acceptance of any modified Terms.
License to Use and Restrictions
2.1 License
Rentalize grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform strictly in accordance with these Terms. This license is granted solely for property management and related professional activities. All other uses of the Service are strictly prohibited.
2.2 Restrictions on Use
You agree to use Rentalize for lawful purposes only. You are prohibited from:
- Copying, reproducing, modifying, or distributing any part of Rentalize's software without prior written consent.
- Reverse-engineering, disassembling, or decompiling the platform or any proprietary aspects of Rentalize.
- Transferring, sub-licensing, or renting your access to the Service to any third party without our consent.
- Misusing or tampering with the system's security, encryption, or authentication procedures.
- Using Rentalize for any illegal or fraudulent activity, including but not limited to the facilitation of rent fraud or improper tenant screening.
Intellectual Property Rights
All content, including text, graphics, logos, software code, and designs on Rentalize.com, are protected under intellectual property laws and remain the exclusive property of Rentalize Software Ltd or its licensors. No part of this platform or its content may be used, reproduced, duplicated, copied, sold, or otherwise exploited for commercial purposes without the express written consent of Rentalize Software Ltd.
Any violation of Rentalize's intellectual property rights will result in immediate termination of your access to the Service and may subject you to legal liability for infringement.
Feedback and Reviews
4.1 Feedback
By submitting feedback, suggestions, or ideas related to the improvement of Rentalize's platform ("Feedback"), you grant Rentalize a perpetual, worldwide, irrevocable, royalty-free license to use, modify, and integrate this feedback into the platform without any compensation or acknowledgment.
4.2 Negative Feedback and Review Process
Before publishing any negative public feedback or review about Rentalize, you must first give Rentalize an opportunity to resolve the issue by contacting our support team. Failure to do so may constitute a breach of these Terms, and any unjustified or defamatory feedback may lead to legal action. Rentalize reserves the right to seek legal remedies for any public comments that damage our business reputation without prior notice to us.
User Accounts and Security
5.1 Account Creation
To access certain features of the platform, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
5.2 Account Security
You must notify Rentalize immediately of any unauthorised use of your account or any other breach of security. Rentalize will not be liable for any loss or damage arising from your failure to comply with this security obligation.
5.3 Account Termination
Rentalize reserves the right to suspend, restrict, or terminate your account at our discretion if you violate these Terms or engage in unlawful, fraudulent, or harmful activities.
Data Privacy and GDPR
Your use of the platform is subject to our Privacy Policy, which is compliant with the General Data Protection Regulation (GDPR) and other applicable data protection laws. By using Rentalize, you consent to the collection, processing, and storage of your personal information in accordance with the Privacy Policy.
We implement appropriate technical and organisational measures to ensure a level of security appropriate to the risks associated with the processing of your personal data.
Payment and Fees
7.1 Payment Terms
The use of certain premium features of Rentalize's platform requires a paid subscription. Payment terms, billing cycles, and associated fees will be detailed upon subscription. You agree to provide accurate and complete payment information and to keep this information up to date.
7.2 Refunds
All subscriptions are non-refundable unless otherwise stated in the applicable subscription agreement. In the event of billing errors, you must notify Rentalize within 30 days of the error. Rentalize reserves the right to correct errors and update charges accordingly.
Warranties and Disclaimers
The Rentalize platform is provided on an "as is" and "as available" basis. While we strive to ensure high availability, Rentalize makes no warranties or representations, expressed or implied, regarding:
- The availability, accuracy, or completeness of the platform or its content.
- That the Service will be uninterrupted, timely, secure, or error-free.
- That the platform will meet your specific requirements.
- That any defects or errors will be corrected.
Rentalize disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The use of the platform is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Rentalize shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, arising from:
- Your use or inability to use the platform.
- Unauthorised access to or alteration of your data.
- Statements or conduct of any third party on the platform.
Indemnification
You agree to indemnify, defend, and hold harmless Rentalize, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses arising from:
- Your use of the platform.
- Your violation of these Terms.
- Your violation of any applicable laws or regulations.
- Third-party claims arising out of your use of the platform or your relationship with tenants, property owners, or other parties.
Legal Actions
11.1 Legal Remedies
In addition to any other remedies available at law, Rentalize reserves the right to seek injunctive relief or specific performance in any court of competent jurisdiction to enforce the provisions of these Terms.
11.2 Dispute Resolution
Any disputes arising out of or in connection with these Terms shall be resolved through mediation or arbitration in Ireland, as agreed upon by both parties. If mediation fails, the dispute shall be submitted to the courts of Ireland for resolution.
Modifications and Amendments
Rentalize reserves the right to modify, amend, or update these Terms at any time. Changes will be effective upon posting on the platform. Your continued use of the platform following any modifications constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.
Miscellaneous Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rentalize regarding your use of the platform.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
14.3 Waiver
The failure of Rentalize to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
