Is AI tenant selection legal in Ireland under GDPR?

Yes, with conditions. The system must be transparent. The applicant must have the right to human review. The system must not make solely automated decisions with legal or similar effects on the applicant. This rule comes from GDPR Article 22. In practice, AI can rank and prioritise applicants. A human must still sign off the final letting decision. The audit trail must be kept.

What does GDPR Article 22 say about automated decisions?

Article 22 gives applicants a right. They cannot be subject to a decision based only on automated processing. The rule applies when the decision has legal or similar effects. For lettings, a landlord cannot reject an application on an algorithm score alone. The applicant must be able to request human review. They can also contest the decision and get a meaningful explanation.

How is fraud detection used on rental applications?

Automated fraud checks review submitted payslips, bank statements, and ID documents. The checks compare them against issuer fingerprints and pattern libraries. They also flag duplicates across applications. Rentalize Select processed 4,600 applications in one week for a Local Authority customer. It flagged a fraud rate of just over 3 percent. Almost all of those would have passed a manual review.

What audit trail do Local Authorities and AHBs expect?

Public sector buyers expect a per-decision record. The record must show the inputs used and the model version. It must include the score returned, the human reviewer, and the final outcome. The record is kept for the life of the tenancy plus 7 years. ISO 27001 certified platforms usually meet this standard out of the box. The LGMA has said this will become a procurement requirement during 2026.

Can AI scoring be used for social housing allocations?

Social housing allocations are governed by each Local Authority allocation scheme and the Housing Acts. So the substantive ranking is a policy matter, not an AI one. AI is used to automate the operational checks. These include income verification, RTB cross-reference, fraud screening, and document parsing. The allocation decision itself stays with a human allocations officer.
